Activity Description The Visitor wishes to participate in agritourism activities at the above-named farm/ranch ("Farm"), which may include: **Activity Type:** ___________ **Visit Date(s):** ___________ ## 2. Acknowledgment of Risks (a) The Visitor acknowledges that agritourism activities take place in a working agricultural environment and involve inherent risks that cannot be fully eliminated. (b) These risks include but are not limited to: uneven terrain, holes, mud, and slippery surfaces; proximity to farm machinery and equipment; contact with animals (biting, kicking, scratching, trampling, allergic reactions, zoonotic diseases); exposure to insects, ticks, snakes, and wildlife; exposure to dust, pollen, hay, pesticides, and fertilizers; sunburn, heat exhaustion, and dehydration; slips, trips, and falls; cuts, scrapes, and puncture wounds; allergic reactions to plants, animals, or food products; and risks associated with hayrides, corn mazes, and outdoor activities. (c) The Visitor voluntarily assumes all risks of injury, illness, property damage, or death arising from participation in agritourism activities at the Farm. ## 3. Waiver and Release of Liability THE VISITOR HEREBY RELEASES, WAIVES, AND DISCHARGES THE FARM, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, INJURY, OR DEATH THAT MAY BE SUSTAINED BY THE VISITOR OR ANY MEMBER OF THE VISITOR'S PARTY WHILE ON THE FARM PREMISES OR PARTICIPATING IN AGRITOURISM ACTIVITIES. This release applies regardless of whether such loss, damage, or injury is caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law. The Visitor acknowledges that many states have enacted agritourism liability limitation statutes (e.g., state agritourism immunity acts) that may limit the liability of agritourism professionals for injuries arising from inherent risks of agritourism activities, and that this waiver is intended to supplement such protections where applicable. ## 4. Indemnification The Visitor agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or expenses (including reasonable attorney's fees) arising from the Visitor's or any guest's actions on the Farm premises, including damage to Farm property, animals, or crops. ## 5. Minors
