# Aircraft Charter Agreement (Part 135) This Aircraft Charter Agreement ("Agreement") is entered into as of ___________ by and between: **Operator:** ___________, a FAA Part 135 Certificated Air Carrier (Certificate No. ___________), with principal offices at ___________ ("Operator"); and **Charterer:** ___________, with a mailing or billing address of ___________ ("Charterer"). --- ## 1. Regulatory Basis Operator is certificated by the Federal Aviation Administration under 14 C.F.R. Part 135 to conduct on-demand air transportation. All flights conducted under this Agreement shall be operated in accordance with 14 C.F.R. Part 135, applicable FARs, and Operator's approved Operations Specifications ("OpSpecs"). The Pilot-in-Command has final authority over all matters concerning the safety of the flight pursuant to 14 C.F.R. § 91.3 and § 135.75. --- ## 2. All crew members shall hold current medical certificates and appropriate type ratings or aircraft category/class ratings. ### 2.3 Substitute Aircraft Operator reserves the right to substitute an aircraft of equal or greater capability with advance notice to Charterer. A substitute aircraft shall meet all applicable FAR requirements for the flight. If the substitute materially reduces passenger capacity or range below that agreed herein, Charterer may cancel this Agreement and receive a full refund of any amounts paid. ---
