# Contract Brewing / Production Agreement This Contract Brewing / Production Agreement ("Agreement") is entered into as of ___________ by and between: **Brand Owner:** ___________, a ___________ organized under the laws of ___________, with its principal place of business at ___________ ("Brand Owner"); and **Brewery:** ___________, a ___________ organized under the laws of ___________, with its principal place of business at ___________, holding TTB Brewer's Notice number ___________ and state license number ___________ ("Brewery"). --- ## 1. Definitions 1.1 **"Products"** means the malt beverage(s) described in Exhibit A produced by Brewery for Brand Owner under this Agreement. 1.2 **"Recipes"** means the brewing recipes, specifications, ingredient bills, and process parameters provided by Brand Owner for the Products. 1.3 **"Specifications"** means the quality, chemical, sensory, and packaging standards for the Products as set forth in Exhibit A. 1.4 **"Batch"** means a single production run of a Product as defined in Exhibit A. 1.5 **"Barrel"** means 31 U.S. gallons of finished beer (as defined in 26 U.S.C. § 5052). 1.6 **"TTB"** means the Alcohol and Tobacco Tax and Trade Bureau. 1.7 **"COLA"** means Certificate of Label Approval issued by the TTB. --- ## 2. Scope of Services 2.1 **Production.** Brewery agrees to brew, ferment, condition, package, and store the Products for Brand Owner in accordance with the Recipes, Specifications, and production schedule set forth in Exhibit A. 2.2 **Ingredients.** Unless otherwise specified in Exhibit A: [ ] **Brand Owner** shall supply the following proprietary ingredients: ___________ [ ] **Brewery** shall procure all other ingredients using commercially reasonable quality standards consistent with the Specifications. 2.3 **Equipment.** Brewery shall use its own equipment unless otherwise agreed in writing.
