Purpose and Authority (a) The Broker is a licensed property broker authorized by the Federal Motor Carrier Safety Administration (FMCSA) to arrange transportation of property by motor carriers. (b) The Carrier is a licensed motor carrier authorized by the FMCSA to transport property in interstate and/or intrastate commerce. (c) The Broker engages the Carrier as an independent contractor to provide transportation services for shipments tendered by the Broker on behalf of its customers ("Shippers"). ## 2. Carrier's Obligations The Carrier agrees to: (a) Transport shipments in a safe, timely, and professional manner in accordance with all applicable federal, state, and local laws and regulations, including but not limited to the Federal Motor Carrier Safety Regulations (49 CFR Parts 350-399). (b) Maintain active operating authority (MC number) and USDOT registration throughout the term of this Agreement. (c) Provide suitable, clean, and properly maintained equipment for each shipment.
