# Pilot Independent Contractor Agreement This Pilot Independent Contractor Agreement ("Agreement") is entered into as of ___________ by and between: **Operator:** ___________, a ___________ organized under the laws of ___________, with principal offices at ___________ ("Operator"); and **Pilot:** ___________, an individual residing at ___________ ("Pilot"). --- ## 1. Regulatory Background and Contractor Classification ### 1.1 FAA Regulatory Basis This Agreement covers operations conducted under ___________. Regulatory basis details (if "Multiple" selected above): ___________ When Pilot is providing services for Part 135 operations, Pilot shall be listed on Operator's Air Carrier Certificate and shall comply with Operator's Operations Specifications ("OpSpecs") and General Operations Manual ("GOM"). ### 1.2 Independent Contractor Status The Parties intend that Pilot is an independent contractor, not an employee of Operator, for all purposes including but not limited to federal and state income tax, FICA, FUTA, workers' compensation, and employee benefits. Operator shall not withhold income taxes, Social Security, or Medicare from compensation paid to Pilot. Pilot is responsible for all self-employment taxes on amounts paid under this Agreement. This Agreement does not create an employment relationship, partnership, joint venture, or agency. ### 1.3 PIC Authority Unaffected Nothing in this Agreement shall be construed to limit the Pilot-in-Command's non-delegable authority and responsibility for the safe operation of any flight pursuant to 14 C.F.R. § 91.3 and, where applicable, 14 C.F.R. § 135.75. Operator shall not direct Pilot to operate any aircraft in a manner that would violate applicable FARs. --- ## 2.
