Interest Rate This Note shall bear interest at a rate of **___________** percent (%) per annum, calculated on the outstanding principal balance. **USURY SAVINGS CLAUSE:** Notwithstanding any provision of this Note to the contrary, the total of all charges constituting interest under applicable law (including interest, fees, late charges, and any other amounts deemed interest by law) shall not exceed the maximum rate permitted by the laws of the governing state. If the aggregate of all such charges exceeds the maximum permissible rate, the excess shall be applied first to reduce the outstanding principal balance, and any remaining excess shall be refunded to the Borrower. If the stated interest rate exceeds the legal maximum, it shall be automatically reduced to the maximum permissible rate. This provision shall control over any other provision of this Note. ## 2.
